1. Compliance with Laws
Bergen INC will strictly enforce all State and Federal Laws. The purchaser/renter of the limousine is responsible for their guests.
2. Prohibited Activities
- People may consume no alcoholic beverages under the legal drinking age (21).
- No illegal drugs are allowed to be stored or consumed in the limo.
- No contraband is allowed aboard vehicles owned or operated by Bergen INC.
- No sexual activities are allowed onboard our vehicles.
- No smoking is allowed in our limousines.
3. Service Termination
Upon determination that any of the above policies were violated, Bergen INC may terminate service to the client and shall be deemed to have fulfilled its contractual obligations under the agreement.
4. Personal Belongings
Bergen INC will not be responsible for any belongings left in the vehicle. If items are found, Bergen INC reserves the right to charge a delivery fee for returning lost items.
5. Payment Terms
- All deposits and payments are charged to the credit card the purchaser/renter provides unless payment is made in person.
- The vehicle is reserved for the purchaser/renter upon approval of the credit card as per the agreement.
- The open balance is due immediately at the beginning of the agreed job in CASH. No credit cards or personal or business checks will be accepted.
- If the balance is not paid in CASH, Bergen INC will not start the job and reserves the right to cancel the service.
6. Cancellation Policy
- All payments/deposits are non-refundable and non-transferable.
- Cancellation requests must be received in writing and signed by a Bergen INC representative.
- Cancellations made within 45 days will not be responsible for the remaining balance, and no deposit will be refunded.
- Cancellations made less than 45 days before the service will be responsible for the balance due.
7. Credit Card Disputes
If the purchaser/renter initiates a credit card dispute for any paid amounts, the reservation will be automatically considered canceled with no refund.
8. Extra Charges
- Any extra unaccounted passengers traveling in the vehicle are subject to an extra charge.
- Changes to reservations are limited to destinations, locations, pick-up times, vehicle additions, or upgrades.
- Overtime is due in cash on the day of service and must be paid to the chauffeur before overtime begins.
9. No-Show Policy
If a customer fails to show up at the designated pick-up location (NO SHOW), the total amount of contracted time will be charged. To avoid being charged as a no-show, contact Bergen INC or the driver by phone at the beginning of the job.
10. Vehicle Malfunctions
Bergen INC offers high-tech-equipped vehicles; however, heat and excessive use of power-operated equipment might cause temporary failure. This will not interfere with the vehicle's safety and will not affect continuing or paying for the contracted trip.
11. Replacement Vehicles
Bergen INC agrees to send the requested vehicle per the reservation/contract. We have the right to upgrade or switch vehicles in case of emergency breakdowns or accidents. No additional charges will occur if the upgrade is made without the customer's request.
12. Liability for Damages
The renter/purchaser agrees to be fully liable for all charges that may incur due to damages caused during the rental period, including:
- $10.00 for each cracked, broken, or missing glass.
- $700.00 per damaged seat, $500.00 per damaged carpet, $750.00 per damaged mirror.
- $100.00 minimum for extensive cleanup (spills, etc.), $50.00 for gum cleanup from the carpet.
- $200.00 for shampoo and disinfecting due to a sick interior, and $150.00 for detailing and wax due to a sick exterior.
- $500.00 minimum for each burn hole, rip or tear to upholstery.
- $500.00 minimum for each act of vandalism.
- $2000.00 for opening a car door into another vehicle or stationary object.
- Triple charge for all removed/stolen items from the vehicle.
